While this is a nice gesture, no law states that any employee is entitled to take paid vacation days in Georgia. However, companies may enact their own policies regarding the matter. Does My Employer Have to Offer Paid Vacation Days?

No federal or state law in Georgia requires employers to provide employees with either paid or unpaid vacation days. While many companies choose to offer paid time off as a benefit or incentive, they are within their rights to abstain from offering vacation time.

An important note is that if an employer chooses to provide their employees with benefits like paid vacation days, they must abide by the terms of that right. Policies must be established in some written handbook or guide that binds the employer to comply with the terms.

Most employers do offer their full-time employees some form of paid time off. Since there are no regulatory laws regarding the issue, every company will have a unique policy for paid time off. Companies can choose:

  • Who is eligible for paid vacation days
  • How vacation time accrues
  • When vacation days can be used
  • A cap for the amount of time that can be accrued
  • When vacation days expire
  • Whether or not they can be rolled over to the next period

While the United States average is 11 days, in Georgia, workers receive an average of 8.4 paid vacation days annually.

Who Can Receive Paid Time Off?

Employers can offer zero vacation days, choose to give all of their employees unlimited paid time off, only allow full-time employees to take days, etc. As long as there is no discrimination involved in these decisions and paid time off is not determined by race, religion, disability, sex, sexual orientation, etc. employers can offer as much or as little vacation as they please.

Can I Be Paid if I Don’t Use My Vacation Days?

While some states require that employers pay employees for unused vacation days, Georgia state law does not have this stipulation. However, depending on your company’s policies you may be able to receive monetary compensation for vacation days that you haven’t used.

Much like the choice of whether or not to offer paid vacation days in general, Georgia employers can choose their policies regarding unused days. Some companies may choose to pay employees for unused vacation days if they are terminated before getting the chance to use them while others may not.

For unused days at the end of the year or term, companies can create their own guidelines. Some employers may allow a certain amount of days to roll over and be used during the next year while others will establish that the days expire.
